The Quebec Construction Association (ACQ) provides contractors with a virtual plan room that lists projects mainly published on SEAO, whose address (URL) is https://salledeplans.acq.org (hereinafter referred to as ACQ Plan Room). It is a high-performance, intuitive, and secure solution that allows contractors and suppliers who are members of ACQ’s affiliated associations (Regional ACQs) to access thousands of public tenders while facilitating their management activities and networking with their partners.

Acceptance and Modification of Terms of Use

By using the ACQ Plan Room, you acknowledge that you have read, understood, and accepted the terms of use set out below as well as all additional documents and/or conditions expressly incorporated by reference (hereinafter collectively referred to as the Terms of Use). If you do not wish to be bound by the Terms of Use, you must stop using the ACQ Plan Room.

The ACQ reserves the right, at any time, to modify, change, or update the Terms of Use at its sole discretion and without notice. These additions, modifications, and updates take effect upon being posted on the ACQ Plan Room. It is therefore advisable to refer to them regularly. If you continue to use the ACQ Plan Room and the services available after the publication of these changes, you are deemed to have accepted them.

In the event of non-compliance with the Terms of Use, the ACQ may, at its discretion and without notice, suspend your access to the ACQ Plan Room and, if applicable, take any other necessary measures to enforce the Terms of Use.

Intellectual Property Rights

You acknowledge that the ACQ Plan Room and everything related to it, including its content, features, and functionalities, belong exclusively to the ACQ or, as the case may be, to its licensors or other suppliers of this material, and are protected by all applicable Quebec, Canadian, and foreign laws relating to intellectual property, including copyright law, trademarks, patents, or any other property rights, regardless of the nature of the medium and the form in which they are accessible.

The ACQ name and logo, as well as, without limitation, all names, logos, product and service names, designs, images, and slogans displayed on the ACQ Plan Room or other ACQ sites, are trademarks of the ACQ or its affiliates, licensors, or suppliers. Unless expressly authorized, the use of such trademarks constitutes an infringement or violation of the owner’s rights and may violate various laws, potentially exposing the infringer to legal action.

No part of the ACQ Plan Room may be reproduced, stored in a retrieval system, or transmitted in any form or by any means, including electronic, mechanical, photocopying, recording, or otherwise, without the prior written consent of the ACQ.

Right of Use

Your credentials (username and password) or those of any sub-user you identify and authorize on your account are confidential and strictly reserved for your exclusive use or that of the authorized user. Any use, whether fraudulent or not, made using the credentials is entirely your responsibility.

Subject to compliance with the above-mentioned access terms and the Terms of Use, you are granted a non-exclusive, non-transferable, and limited right to access and use the ACQ Plan Room and the available features.

Restriction on the Right of Use

Unless otherwise authorized in writing by the ACQ, it is strictly prohibited, by any means whatsoever, to:

• Modify the content of the ACQ Plan Room in any way, by addition, deletion, or otherwise, and remove the name or logo of the ACQ, its affiliates, licensors, or suppliers;
• Use, reproduce, adapt, save, publish, download, distribute, or otherwise store the content of the ACQ Plan Room for purposes other than those permitted by the ACQ Plan Room;
• Sell all or part of the content of the ACQ Plan Room or exploit or allow a third party to exploit commercially or otherwise the content of the ACQ Plan Room, including technology belonging to the ACQ. Without limiting the foregoing, commercial use of the content, whether for profit or not, is prohibited;
• Use the ACQ Plan Room, its content, and its features in a way that could damage it or compromise its performance and security, or render it inoperable;
• Use any system or mechanism intended to enable external indexing of services, including robots, parsers, indexing robots (spiders), and other indexing or automatic downloading tools.

If you use translation tools, the use of these tools is at your own risk, and the ACQ has no control over these translation tools or the quality of the translation and assumes no responsibility in this regard.

Limitation of Liability

The ACQ (administrators, directors, employees, agents, or other representatives), including but not limited to its affiliated entities, regional ACQs, licensors, partners, or suppliers, makes no representations and provides no warranties, including but not limited to, that the content or access to the ACQ Plan Room will be complete, reliable, accurate, error-free, defect-free, timely, uninterrupted, punctual, free of computer viruses or other harmful elements, and shall not be held liable in any way in this regard. Furthermore, in the event of a discrepancy between an official text and the content of the ACQ Plan Room, the official text shall prevail.

You must enable update alerts in the ACQ Plan Room to ensure you receive any notifications regarding changes, including to projects and/or documents viewed, downloaded, or ordered.

Despite the efforts made by the ACQ to ensure the proper functioning of the ACQ Plan Room, it cannot be held responsible for:

• Its performance;
• The interruption or suspension of access to the ACQ Plan Room, including in cases of maintenance, network problems, outages, or events beyond its control, including force majeure, or any direct or indirect damages of any kind arising directly or indirectly from the ACQ Plan Room, its use, application, or interpretation;
• Any loss or damage of any kind related to your computer system, including but not limited to data loss, virus transmission, attempted intrusions, and the hacking of data, files, or programs it contains.

Links to Other Websites

The ACQ Plan Room may include, for informational purposes, links to other websites. The ACQ cannot guarantee the accuracy, completeness, or availability of the information contained on these sites, nor the security or compliance with privacy policies of these sites.

The ACQ cannot be held responsible for any damage of any kind related to the use of or reliance on content, goods, or services available on these external sites.

Consent and Privacy

When subscribing to the ACQ Plan Room, the ACQ collects certain data from you, including your name, the names of any other authorized sub-users on the account, the type of business, business sectors, and your contact information for the provision of your credentials (username and password).

You agree to promptly inform the ACQ of any changes to the information you have provided.

Additionally, when you use the features available in the ACQ Plan Room, the ACQ collects the following information:

• The credentials (username and password);
• The IP address;
• The operating system;
• Online activity;
• The date and time of login;
• The name(s) of the document(s) downloaded or ordered;
• The HTTPS response code.

This information will be used for:

• To enhance your user experience;
• To offer you personalized products and services; or
• For research, evaluation, advertising, and survey purposes.

By using the ACQ Plan Room, you expressly agree that your collected information may be used for the aforementioned purposes and that it may be accessible to ACQ employees, partners, agents, or service providers who need to know it in the course of their duties or in the execution of their mandate or contract.

Absence of Legal Advice or Recommendation
