PRIVACY POLICY

The present policy sets out the principles and guidelines of the Association de la construction du Québec and regional associations (collectively hereafter referred to as ACQ) regarding the protection of personal information obtained through the use of the ACQ Plans Room (hereafter referred to as the Site) (Policy).

Personal information is any information that relates to a natural person and allows them to be identified directly or indirectly.

The ACQ is committed to implementing the necessary measures to ensure the confidentiality of this personal information.

CONSENTEMENT

By accessing the Site and providing personal information to the ACQ, the user consents to the collection, use, or disclosure of the information provided, in accordance with this Policy and as permitted or required by law.

COLLECTION, USE, AND DISCLOSURE OF PERSONAL INFORMATION

The ACQ may request the following personal information: name, first name, phone number, fax number, and email address, when necessary for subscriptions, service requests, and information requests in order to contact the user.

The personal information provided to the ACQ is handled with care and kept securely for the duration necessary for the determined purposes and, subject to this Policy or the law, will not be used in any way without the user’s consent.

MODE OF COLLECTION

Information transmitted automatically

When the user accesses the Site, an exchange of information occurs automatically between their computer and the server hosting the Site, without any human intervention. The exchanged information is as follows:

  • The domain name of your Internet service provider and the IP address (generally, an IP address is a unique number assigned to a computer when it is connected to the Internet and which helps route documents intended for it accurately);
  • The type of browser and operating system used;
  • The date and time of access to the Site;
  • The pages visited and the duration of these visits;
  • If the user accesses the Site from another site, the address of that site (referring site).

This exchange of information is necessary due to the technological requirements inherent in Internet browsing. The ACQ retains the information necessary to collect data on the number of visitors, the most frequently visited pages, the technology used by users of the Site, referring sites, and the countries of origin of users. This information is not used to establish, communicate, or exchange user lists or profiles.

In addition, the ACQ works with third-party service providers to perform various services for the operation of the Site, including:

  • Google Analytics is a website analytics service provided by Google Inc. that uses cookies, which are text files placed on your computer, to help the website analyze how users use the site.
  • The data generated by the cookies concerning your use of the Site (which includes your IP address) will be transmitted and stored by Google Inc. on servers located in the United States. Google Inc. will use this information to evaluate your use of the Site, compile reports on Site activity for its publisher, and provide other services related to Site activity and Internet usage. Google Inc. may share this data with third parties in case of legal obligations or when these third parties process this data on behalf of Google Inc., including specifically the publisher of this Site. Google Inc. will not combine your IP address with any other data held by Google Inc. The user can disable the use of cookies by selecting the appropriate settings in their browser. However, such disabling may prevent the use of certain features of this Site.
  • By using the Site, the user expressly consents to the processing of this personal data by Google Inc. under the conditions and for the purposes described above.

The user can install the browser add-on to disable Google Analytics on their computer, available at: https://tools.google.com/dlpage/gaoptout. This add-on prevents Google Analytics from recording data about the user's visits.

This Policy applies only to the Site and does not extend to websites, products, or services provided by third parties. The personal information collected is subject to this Policy, while the personal information collected by these third-party operators is subject to their own privacy policies. The ACQ assumes no responsibility for the privacy practices of these third parties.

Information about navigation cookies

Cookies, commonly referred to as ‘cookies’, are files saved by a web server on your computer.

Cookies facilitate web use by saving and managing user status, preferences, and other related information. Most browsers are initially configured to accept cookies, but users can modify the settings to refuse cookies or to be alerted when cookies are sent. Instructions for changing cookie settings can be found in the browser's Help menu. While refusing cookies does not affect the ability to interact with the Site, users must accept cookies to use certain features (e.g., accessing the plans room) available on the Site. If users choose to disable cookies by configuring their software, they can continue to browse the Site. However, any malfunction of the Site caused by this action cannot be considered our responsibility.

Cookies are used (sometimes in conjunction with other technologies such as JavaScripts) to track user status and preferences, for security reasons, to understand visitor behavior on the Site anonymously, and to assess the effectiveness of certain promotional efforts.

Except for cookies used for the needs of registered users on the Site or for transferring information between Site applications, the information collected by cookies and JavaScripts is not used by the ACQ to identify an individual. Cookies are placed each time a user logs in and are non-permanent.

Access to Personal or Otherwise Confidential Information

ACQ may divulge personal information on users without their permission when necessary to supply a product or service, for requests filled by a third party, or when ACQ believes in good faith that it is required by the law.

Use of Personal Information

The collected information will be used for the following purposes:

  • Create your user account and enhance your user experience with the ACQ Plans Room;
  • Offer personalized products and services;
  • For evaluation, statistical, or survey purposes, as applicable;
  • To identify and address technical issues with the ACQ Plans Room;
  • Improve the performance of the ACQ Plans Room;
  • Any other use permitted by applicable legislation.

Personal information can only be used within the ACQ for the purposes for which it was collected, unless the user consents or as permitted by law.

However, personal information may be used for other purposes without the user's consent, notably when its use is compatible with the purposes for which it was collected, when its use is necessary for providing or delivering a requested product or service, or as permitted by law.

DISCLOSURE OF PERSONAL INFORMATION

The ACQ discloses personal or otherwise confidential information via email, securely.

The collected personal information will be accessible to ACQ staff who need to know it in the course of their duties.

The ACQ may disclose the user's personal information (name, first name, physical address, phone number, fax number, and email address) to one of its partners, service providers, or agents, without the user's consent, when necessary for performing a mandate or executing a service or business contract for which the personal information was provided, or as required or permitted by law. When required, the ACQ will obtain the user's consent.

SECURITY MEASURES

The ACQ uses recognized technology to protect and secure the information transmitted to it.

The ACQ has implemented physical, technological, and administrative measures to ensure the confidentiality and security of personal information to prevent unauthorized access, use, or disclosure and any other breaches of such information protection. These security measures are tailored to the sensitivity of the personal information, its intended use, quantity, distribution, and medium.

However, since electronic data transmission cannot be completely protected, the ACQ cannot guarantee absolute security of the transmitted information.

If the user has reasons to believe that personal information has been compromised, they should contact the ACQ's Personal Information Protection Officer at RPRP@acq.org.

LINKS TO OTHER SITES

The Site may include, for informational purposes, hyperlinks to other sites. When the user follows these links, they leave the Site. The ACQ cannot guarantee the accuracy, completeness, availability of information on these sites, or their security or compliance with privacy rules. The information exchanged is no longer subject to this Policy, but to that of the visited sites. The ACQ assumes no responsibility for the privacy practices of these sites.

The ACQ encourages users to take precautions when leaving the Site and to read the privacy policies posted by the relevant third parties that may apply.

RIGHT TO OPPOSE AND WITHDRAW / RIGHT TO ACCESS, RECTIFICATION, AND DELETION

The user has the right to withdraw their consent to the use or disclosure of their personal information.

Such withdrawal may limit or even prevent the ACQ from offering certain products or services.

The user also has the right to make a written request to access their personal information and to request its rectification.

In addition, the user can review, update, modify, or request the deletion of their personal information, except as limited by law. At any time, the user can view the information that the ACQ holds about them by accessing their 'Profile' from the homepage of the ACQ Plans Room at salledeplans.acq.org. To access their profile, the user must log in using their email address and password. A 'My Account' link is available in the main menu, providing access to the different sections of the profile.

To exercise these rights, the user must make a written request to the ACQ's Personal Information Protection Officer at RPRP@acq.org. The request will be processed within 30 days or within a longer period if required by law.

In all cases, the ACQ may need to retain certain personal information to comply with legal obligations.
